Welcome to iHaYi (hereinafter referred to as "we", "us", "our"). This Legal Statement (hereinafter referred to as the "Statement") is formulated in accordance with relevant laws, regulations and rules of the United States, the European Union, the United Kingdom and other regions where our Shopify independent station (hereinafter referred to as the "Station") operates. It clarifies the legal rights and obligations between us and users (hereinafter referred to as "you") when using the Station and its related services. By accessing, browsing, registering or using any services of the Station, you acknowledge that you have read, understood and fully agreed to all the terms of this Statement. If you do not agree to any content of this Statement, please stop using all services of the Station immediately.

2.1 We strictly abide by the relevant laws and regulations of the regions where the Station operates, including but not limited to the General Data Protection Regulation (GDPR) of the European Union, the California Consumer Privacy Act (CCPA) of the United States, the Electronic Commerce Directive of the European Union, and the relevant tax and product safety regulations of the United States, the United Kingdom and the European Union, and operate the Station in accordance with the law to ensure the legality, compliance and transparency of all business activities.
2.2 For products sold on the Station, we ensure that they meet the relevant safety standards and certification requirements of the target market: electronic and electrical products comply with CE certification (including EMC and LVD directives) for the European Union and FCC certification for the United States; toys comply with EN71 certification; products involving batteries comply with the EU Battery Regulation (EU Batteries) and complete relevant registration procedures; children's products comply with CPC certification for the United States, and all products are labeled with compliant information such as manufacturer name, address and relevant certification marks as required.
2.3 We strictly abide by relevant tax regulations, complete VAT registration in the European Union, the United Kingdom and other regions as required, truthfully declare and pay taxes, and ensure that the displayed product prices comply with regional regulations (for example, the final price displayed in the European Union includes all taxes and fees including VAT).

3. Intellectual Property Rights

3.1 All intellectual property rights related to this Station, including but not limited to trademarks, logos, text, pictures, videos, audio, product designs, software codes, and the layout and arrangement of the Station, are owned by iHaYi, its affiliates or authorized licensors, and are protected by the intellectual property laws of the United States, the European Union, the United Kingdom and other countries and regions.
3.2 Without our prior written consent, you shall not reproduce, distribute, modify, decompile, reverse engineer, rent, lend, sell, or otherwise use any intellectual property rights of this Station in any form. Any unauthorized use may constitute an infringement of intellectual property rights, and we reserve the right to pursue your legal liability in accordance with the law.
3.3 The trademarks, logos and product names of third parties displayed on this Station are the property of their respective owners. We only display them for the purpose of product description and transaction, and do not mean that we have obtained any authorization or ownership of such intellectual property rights. If you believe that the display of third-party intellectual property rights on this Station infringes your legitimate rights and interests, please contact us in a timely manner, and we will handle it immediately after verification.

We do not control, review or endorse such third-party websites or services, and shall not be liable for any losses, risks or disputes arising from your access to or use of such third-party websites or services. You shall independently judge and bear the corresponding risks when accessing third-party links.
5.5 We shall not be liable for any delivery delays caused by force majeure factors such as bad weather, natural disasters, customs clearance, and logistics carrier problems; once the goods are handed over to the logistics carrier, the risk of loss and damage of the goods shall be transferred to you.

6.1 When using the Station, you shall abide by relevant laws, regulations and rules of the country/region where you are located and this Statement, and shall not engage in any illegal or improper behavior, including but not limited to:
  • Infringing upon the intellectual property rights, privacy rights, reputation rights and other legitimate rights and interests of us or third parties;

  • Using the Station to engage in fraud, phishing, spam and other illegal activities;
  • Using robots, crawlers and other tools to crawl, collect or extract data from the Station without authorization;
  • Reselling the products purchased on the Station for commercial purposes or exporting them in violation of relevant regulations;
  • Other behaviors that violate laws, regulations or this Statement.
6.2 If you violate the above obligations and cause losses to us or third parties, you shall bear full compensation liability, and we reserve the right to suspend or terminate your access to the Station and pursue your legal liability in accordance with the law.

7. Applicable Law and Dispute Resolution

7.1 This Statement shall be governed by and construed in accordance with the laws of the jurisdiction where iHaYi is headquartered. For disputes arising from your use of the Station and related services, both parties shall first try to resolve them through friendly negotiation.
7.2 If the negotiation fails, either party may file a lawsuit with the competent court in the jurisdiction where iHaYi is headquartered. During the dispute resolution process, the valid terms of this Statement shall continue to be implemented.

8. Other Provisions

8.1 We reserve the right to modify or update this Statement at any time in accordance with changes in laws, regulations or business needs. The revised Statement will be posted on this Station and will take effect on the date of posting. Your continued use of the Station after the revision of the Statement shall be deemed as your acceptance of the revised Statement. It is your responsibility to check the latest version of the Statement regularly.
8.2 If any provision of this Statement is deemed invalid or unenforceable due to violation of relevant laws and regulations, such provision shall be deemed to be severed from this Statement, and the validity and enforceability of other provisions shall not be affected.
8.3 This Statement is an important part of the legal agreement between you and us. If there is any conflict between this Statement and our Privacy Policy, Refund Policy, Shipping Policy and other relevant policies, this Statement shall prevail; if there is no relevant provision in this Statement, the relevant policies shall prevail.
